Description of Service
1107596 Alberta Ltd, operating as SOILWORX.ca, offers, but is not limited to, services and consultations related to the design, installation, inspection, service, and maintenance of water and wastewater systems, as well as general contracting and construction.
Refund/Cancellation
There are no refunds for services provided. Some services may require prepayment or a deposit before start of work. If a prepaid service or scheduled visit is cancelled with min 24hrs notice, a full refund of the prepayment or deposit will be given. Cancellations must be in a written form, email is acceptable. If a prepaid service or scheduled visit is partially completed, the refund will be given at a pro-rated price.
Force Majeure
1107596 Alberta Ltd, operating as SOILWORX.ca, shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that 1107596 Alberta Ltd, operating as SOILWORX.ca will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The client acknowledges and agrees that 1107596 Alberta Ltd, operating as SOILWORX.ca cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results or guarantees are promised. No warranties are implied unless in written format.
Service and Maintenance Work (specifically)
The client acknowledges that if 1107596 Alberta Ltd, operating as Soilworx.ca, is hired to install, repair or replace a malfunctioning, missing, or broken component of their system, if the component is difficult to access, not adequate, or not installed properly, any costs of additional damages that could happen while trying to repair the component or system are not covered by 1107596 Alberta Ltd and are the responsibility of the owner. For example, if a pump does not have adequate (and safe) means to be removed from the tank (such as a strong rope or chain), if additional damages are done to any component within the system during the process of trying to remove or repair the pump, these costs would be the responsibility of the owner for the repair of the new damages.
System Evaluations /Inspections
The client acknowledges that all system evaluations / inspections are a snapshot of information of easily accessible components. Any component that is buried and not easily accessible cannot be assessed completely without excavating and uncovering it. Evaluations/inspections are given using our professional expertise and experience using the information provided and a visual evaluation of the accessible components only.
Overdue Invoices
All overdue invoices are subject to 3% monthly interest penalty, and a monthly admin fee of $20 (per invoice).
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties
